The OpenAI trial, which pits Elon Musk against Sam Altman regarding the nonprofit status of the technology firm, has begun in Oakland, California. The case finally moved to the courtroom after jury selection was completed on Monday.
Elon Musk seeking damages from OpenAI after shift to for-profit status
Billionaire and tech mogul Elon Musk is seeking about $150 billion in damages from OpenAI. Elon Musk filed a lawsuit against the artificial intelligence company for its evolution into a for-profit company after it was created as a non-profit.
Sam Altman, the current CEO of OpenAI, founded the company alongside Elon Musk and some other tech leaders as a nonprofit organisation. The firm then got most of its funding from Elon Musk before becoming a capitalist venture.
Moreover, Musk accuses Altman of reneging on the founding agreement to make OpenAI a nonprofit and, as a result, swindling him out of millions of dollars because of the firm’s shift toward making money. Both Musk and Altman will be testifying in court as the case progresses.
Elon Musk said that Altman and the other defendants deceived him about their plans and exploited his name and financial support. He said they used his resources to create a wealth machine for themselves and therefore owe him damages. Musk said he had donated about $40m to OpenAI.
The lawsuit demands that OpenAI revert to its nonprofit status and that the board remove Sam Altman and Greg Brockman from their positions. The suit also demands that the board totally remove Altman from the company.
However, OpenAI has refuted Elon Musk’s claims. They have called Musk’s efforts those of a competitor who wants to undercut OpenAI’s growth. Elon Musk, after leaving OpenAI, started his own AI start-up known as xAI.
The differences between the two tech leaders have spilt out into the open repeatedly over the past years. Recently, Elon Musk called Sam Altman “Scam Altman” in a post on X.
OpenAI trial ruling has high stakes for all involved
Elon Musk’s lawsuit carries major implications for both OpenAI and himself. If Elon Musk wins the case, it could lead to the restructuring of OpenAI, which could take the firm out of the artificial intelligence market.
Additionally, the trial can uncover insights into the ambition of the tech leaders and their actual intent for developing this technology. If Musk wins the trial, he can position himself as the person to fairly represent the interests of OpenAI.
Elon Musk’s initial interest in buying OpenAI might, however, be a weakness in his case against OpenAI. Last year, OpenAI rejected Musk’s offer to buy OpenAI’s assets for about $97 billion.
